Terms of Service
PictureView is a service of Interactive Classifieds Network Corporation, a
California corporation (hereinafter referred to as "ICNC"). By becoming a member
of PictureView, you are expressly agreeing to the terms of service set forth below. If you
do not agree with any of the terms and/or conditions of membership, you must cease using
PictureView and contact us immediately.
PictureView is a read-only Usenet feed. All content on the PictureView news servers
originates from third parties on the Usenet system. ICNC is not responsible for any
content that originates from third parties.
The subscribing member (that's you) pays for access from one connection at a time. This
means you can use PictureView from wherever you wish, but from only one computer at a
time. Example: You can use PictureView at the office, then log off, go home and log on
there. You may not share your username or password with anyone else. Another example: If
you have access to a network of computers, it would be in violation of our terms of
service to log on to PictureView with several computers and then start simultaneous
downloads. Any member sharing his/her password is responsible for the membership costs of
each additional user that accesses the service using that password. PictureView reserves
the right to pursue all legal remedies for the membership fees and other costs incurred
when a password is traded. If you need more than one account, please contact us.
As soon as you click the sign up button, you are responsible for paying for one month
of service. If you are in doubt, do not sign up until you've examined the free
demonstration archive and are sure of your subscription. We cannot promise that we will be
able to intercept requests to cancel applications before they are processed.
The monthly fee is for one month or any part thereof. We do not provide refunds or
credit for unused time.
PictureView is a service of Interactive Classifieds Network Corporation (ICNetCo), a
premium internet service provider. A membership in PictureView is a membership in
ICNetCo's ISP services, and as such grants you use of our national dial up network. As an
ISP customer, you can dial into any of our continental United States dial in POPs at the
current hourly rate for the first four hours. If you use the dial up service for more than
four hours in any given calendar month, any further hours used in that calendar month will
incur no additional charges for that calendar month. Please contact our support personnel
if you need assistance in setting up dial up access privileges. NOTE: If
you already have Internet access through another provider, you will not incur any fees in
addition to the monthly subscription fee, no matter how much or little you use the
service.
As a PictureView member, you may choose either web-based (HTTP) access, or NNTP access
to the PictureView news servers. To choose NNTP access, please contact our support
personnel for assistance in configuring your system.
ICNC is not responsible for the flow of data, programs, software, graphical images,
animations, any other binary file, or any automatically generated derivations of the
aforementioned, on any server which originates from third parties. We reserve the right to
respond to or not respond to member requests regarding the removal of specific images that
may be considered illegal in our jurisdiction/community. For more information refer to our

ICNC makes no warranty of any kind, expressed or implied, including, but not limited
to, warranties for fitness of purpose or of merchantability, with regard to the quality,
content, accuracy, validity, artistic worth, or even legality of the data, programs,
graphical images, information, etc., that are available.
ICNC makes no representations with respect to the nature, quantity or quality of
content obtain through the PictureView service.
Yearly accounts are billed for one year or any part thereof. We do not provide refunds
or credit for unused time.
We bill accounts within 24 hours of sign up. Accounts are valid from the date paid for
one month and will automatically be re-billed at the end of the month.
All accounts are automatically renewing. If at any point you wish to cancel, you can do
so on our web page or by e-mailing, faxing or calling us. Be prepared to provide your
username, password, and the last four digits of your credit card number for security.
You may cancel at the end of any paid billing period, or you can cancel and terminate
your access immediately, sacrificing any remaining paid days to our service.
You can also request temporary cancellation when going on vacation. We'll e-mail you
instructions on reactivating your account when you return.
Cancellation requests must be made at least 24 hours before the end of your currently
paid period. You will receive confirmation of cancellations via e-mail. If you do not
receive confirmation it means that in all probability your e-mail was not received by us.
You are responsible to make sure that your cancellation is confirmed. If you don't receive
confirmation within 24 hours, contact us again to make sure we've received your request.
Members are responsible for all accounts under their name. In cases where a member
accidentally signs up more than one time, they must notify ICNC immediately in order to
cancel duplicate accounts. ICNC will not be responsible for additional costs incurred by
multiple accounts, as each and every account that is activated is available for the member
to use. Members who have signed up for multiple accounts should contact our customer
service department for additional assistance.
ICNC makes a competent and diligent effort to maintain our servers and internet
connections, but we make no representations with respect to your specific speed of access
to our site.
Outages caused by circumstances outside of ICNC's control, including but not limited
to: any ISP or backbone carrier having problems, any router between your ISP, their
backbone provider, our backbone provider and/or any other part of the internet outside of
our offices, fiber cuts, power failure, earthquake, backhoes, dump trucks, upstream
newsfeed problems, etc...are not ICNC's responsibility. ICNC can not be held responsible
for any damage that you may suffer from the loss of data resulting from non-deliverance,
mis-deliverance, delay, service interruptions or outages, or from any errors or omissions
by us.
In the event of outages caused by problems within PictureView, please check for
notification on our network status page. If, in the event there is an outage of more than
48 hours caused by problems entirely within the control of ICNC, ICNC will make available
to requesting members compensation equal to the actual amount of time lost. Compensation
will take the form of days of service added to the current month paid. ICNC will not make
compensation in cash. Under no circumstances will ICNC be liable for more than one month
of service.
To become a PictureView member, you must be 18 years old or the legal age of consent in
your community, whichever is higher.
Members are expected to know the specific laws and standards of their own community and
adhere to them.
Members acknowledge that they are aware that some of the material presented by
PictureView may be of an offensive or obscene nature.
PictureView has a strict policy against Child Pornography.
PictureView does not claim to carry all Usenet groups. We urge our prospective members
to check our free demonstration archive for the current list of the groups we carry before
signing up, as no guarantees are made with respect to the groups we carry. We reserve the
right to modify the list of groups carried on PictureView without prior notification.
PictureView does not claim to receive all Usenet postings. Postings can be lost
anywhere in the Usenet network as they propagate from server to server. ICNC makes a
reasonable effort to build a news system which will receive as many postings as possible,
but we cannot and will not be held responsible for not receiving any specific postings.
Members are advised that the Usenet is quite diverse and that there are many adult
groups within PictureView's archives. Members attest that they do not find this type of
material objectionable or offensive.
Members understand that this service is for adults only and the material on the Usenet
may be inappropriate for minors. If a member chooses to redistribute any information
obtained via PictureView/Usenet, it is the member's responsibility to do so within the
limits of the law within their community. ICNC is not and can not be held responsible for
possession, usage, or transportation of Usenet material accessed through PictureView
servers.
Members agree to honor all credit card purchases. Credit card disputes for services
already rendered may be considered an act of fraud.
Fraudulent credit card usage will be reported to the appropriate agency. ICNC does not
tolerate credit card fraud.
You must maintain a valid e-mail address on file with ICNC for purposes of
notification.
ICNC reserves the right to cancel any member's account or terminate access at any time
without prior notice. If ICNC attempts to contact you using the information provided on
your account and finds the e-mail address invalid or inactive, ICNC reserves the right to
deactivate the account until we are contacted regarding that account, as we have no other
way of reaching the responsible member.
ICNC reserves the right to change our fees or billing methods at any time and ICNC will
provide notice of any such change at least thirty days in advance via e-mail or web page
notifications.
It will be considered by ICNC to be an act of fraud to use our service in violation of
this agreement.
